Recitals

Personal data processing by the Parkn’Box website, Parkn’Box.com (hereinafter the “Website”) and the Parkn’Box services is subject to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter the “General Regulation on Data Protection”).

This charter (hereinafter the “Privacy Charter”) governs the relationship between the Belgian private limited liability company Moba & Co, doing business as Parkn’Box, and the users of the Website and its customers (hereinafter the “Users/Customers”).

Data controller

The business activities of Parkn’Box require processing of personal data by the controller, the Belgian private limited liability company Moba & Co, based at 1050 Ixelles, rue du Collège, 35, registered with Banque Carrefour des Entreprises under number 0644.477.205 and Belgian VAT number BE 0644.477.205 (hereinafter “PARKn’BOX”).

Personal data and purposes of use

The General Data Protection Regulation defines the term “personal data” as follows:

Any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

By using Parkn’Box‘s services and thus its Website, the User consents to the following data being collected:

  • his/her full name, a copy of his/her valid identity card or passport, so as to be able to identify him/her;
  • his/her postal address, email address and any similar information necessary or useful for the performance of the contract and for processing requests sent to Parkn’Box;
  • his/her telephone number;
  • his/her bank account number (IBAN and BIC);
  • in general, any information provided voluntarily when using the Website or the services, or any request submitted through the Website.

Parkn’Box has a legitimate interest in using the data for the following purposes:

  • allowing Users/Customers to access the services provided by the Website (notably creating a customer account and booking storage space for property);
  • recording User/Customer requests and responding to them;
  • managing the User/Customer database to achieve a global vision of User/Customers;
  • managing User/Customer accounts;
  • managing the Website activities;
  • building Users/Customer profiles to recommend certain services;
  • compiling statistics (such as the number of visits to the Website);
  • complying with or meeting any legal and regulatory requirements;
  • in general, to enable Parkn’Box to best conduct its business of providing facilities for property storage.

Personal data will be processed confidentially by Parkn’Box for the above-mentioned purposes, as well as by specialised subcontractors which Parkn’Box may use for certain services. Parkn’Box will ascertain that they comply with its Parkn’Box privacy policy.

Personal data shall not be sold or made available to third parties except subcontractors, or used for marketing purposes without the express permission of the User/Customer.

Duration of processing

Parkn’Box keeps the personal data of Users/Customers for as long as necessary to conduct its business and to comply with its legal and regulatory obligations, notably for the purposes of tax audits.

Security measures

Parkn’Box has implemented appropriate technical and organisational security measures to prevent the destruction, loss, falsification, modification, unauthorised access by third parties or erroneous notification to third parties of the personal data collected, as well as any unauthorised processing of such data.

User/Customer Rights

Right to rectification, erasure and restriction of processing

Users/Customers have the right, at any time, to:

  • view their personal data free of charge, as well as to be informed of Parkn’Box‘s use of this data;
  • ask Parkn’Box to rectify or complete their personal data.

Users/Customers remain free to decide whether or not to disclose their personal data, request the erasure of such data or request that the processing of such data be restricted. However, these rights are not absolute. Therefore, requests will be examined on a case-by-case basis. In addition, in the event of such a request, Users/Customers acknowledge that PARKn’BOX will be unable to provide them with certain services.

Right to object

Users/Customers have a right to object to the processing of their personal data for compelling and legitimate reasons.

Users/Customers have the right to object to the use of their personal data for direct marketing purposes, without having to give reasons for this objection.

 
Right to data portability

Users/Customers have the right to receive their personal data provided to Parkn’Box in a structured, commonly used and machine-readable format and to transmit this data to other data controllers.

Right to withdraw consent

Insofar as processing is based on the prior consent of the User/Customer, the latter has the right to withdraw this consent.

Exercising user rights

Users/Customers may exercise their rights by contacting Parkn’Box at the e-mail address contact@parknbox.com, subject to appending a copy of their identity card as an attachment.

Automated decision making and profiling

Processing personal data does not include any profiling and will not be the subject of an automated decision by Parkn’Box.

Right to file a complaint

Users/Customers have the right to file a complaint with the Belgian Privacy Commission, whose contact details are as follows:

Cookies

Use of the Website may result in the installation of cookies on the User/Customer’s computer (a cookie is a small file sent by the Parkn’Box server which is saved on the hard drive of the User/Customer’s computer. They keep a record of the site visited and contain a certain amount of information about this visit). 

The cookies used on the Website are used primarily to operate the Website (technical session cookies).

Users/Customers may refuse to have these cookies installed on their computer, but this refusal may prevent them from accessing certain services on the Website.

Newsletters and direct marketing

Parkn’Box wishes to proactively inform Users/Customers about its activities.

Pursuant to the General Data Protection Regulations, Parkn’Box requires Users/Customers to give their prior consent before sending newsletters or any marketing messages.

Furthermore, Parkn’Box will at all times allow Users/Customers to withdraw their consent for any form of communication for information purposes, if relevant.
